1About This Document
Version: 2026-09-13. These Terms of Use take effect on the date of this version and replace all earlier versions.

Read these Terms together with the Privacy Policy, which explains in detail what data we process, how it is protected and what rights you have.
2Acceptance and Consents
By creating an account and using Andesha you accept these Terms of Use. If you disagree with any part of them, do not use the app.
During registration you confirm separately, with individual checkboxes, that you:
- accept these Terms and the Privacy Policy;
- are at least 18 years old;
- consent to your entries being processed by OpenAI for transcription, analysis and AI replies.
An account cannot be created without these confirmations. We record on our servers the fact of your consent and the version of the documents you accepted, so that it is always clear which wording applied at that moment.
You may withdraw your consent at any time — write to amirich.corp@gmail.com or delete your account. Withdrawal does not affect processing already carried out before it. Without consent to AI processing the AI features stop working, while the diary itself remains available.
3Who May Use Andesha
Andesha is available only to people aged 18 and over. There is no version of the service for minors, and we do not offer a parental-consent mechanism.
By registering you confirm that you have reached the age of 18. If we learn that an account belongs to a person under 18, we will block it and delete the associated data.
You must also be legally able to enter into this agreement and must not be a person barred from using the service under the laws applicable to you.
If you believe a minor has created an account, write to amirich.corp@gmail.com.
4Account and Access
To use Andesha you need an account with a valid email address and a password. We send codes to that address to confirm sign-in and to restore a forgotten password, so keep access to your mailbox.
You are responsible for keeping your credentials confidential and for everything that happens under your account. In the app you can turn on an extra lock — biometrics or a separate 6-digit passcode — which we strongly recommend on a shared device.
Provide accurate information at registration and keep it up to date. Write to amirich.corp@gmail.com immediately if you suspect that someone else has gained access to your account.
One person may keep one active account. Creating additional accounts to obtain benefits repeatedly may lead to all of them being blocked.
5What the Service Does
Andesha is a voice and text mood diary with AI features:
- voice and text entries, photos and text recognised from them;
- AI analysis of an entry: mood, stress and energy estimates, brief conclusions;
- conversation with the MoodAI companion, including a live voice mode;
- daily summaries, mood trends and reports;
- personal goals and reminders;
- reading entries aloud;
- search across your entries and offline access to already loaded history.
The set of features depends on your plan. Diary entries are unlimited on every plan, including Free; AI features are available on Starter and Pro. Some capabilities are limited by plan on the server side — for example, the choice of reading voices, text recognition from photos on our servers, and the depth of trend history.
We develop the app continuously and may add, change or discontinue individual features. If a change materially reduces what a paid plan offers, we will notify you in advance and you may cancel the subscription.
6Not a Medical Service. Crisis Situations
Andesha is NOT a medical service, NOT psychological counselling and NOT therapy. MoodAI is a supportive tool for self-reflection, not a licensed therapist, psychologist or doctor. The app is not a medical device and is not intended to diagnose, treat, cure or prevent any illness.
Andesha does not:
- diagnose mental health conditions;
- prescribe medication or treatment;
- replace professional psychological or psychiatric help;
- provide emergency or crisis intervention.
Mood, stress and energy scores are algorithmic estimates, not a clinical assessment of your condition.
IF YOU ARE HAVING THOUGHTS OF SUICIDE OR SELF-HARM, OR IF SOMEONE'S LIFE IS IN DANGER: close the app and call emergency services immediately — 112 in the EU, 911 in the US, or the emergency number in your country — or contact a local crisis line, or go to the nearest emergency department. If you can, tell someone you trust.
Nobody at Andesha reads your entries in real time. The app cannot recognise an emergency, cannot call for help and cannot notify anyone on your behalf. Never postpone a call for help because you wrote it down in the diary, and never make decisions about medication or treatment based only on what the app says — discuss them with a doctor.
7Plans and Subscriptions
Andesha has three plans:
- Free — free of charge and with no time limit. Diaries and entries are unlimited, AI features are not included, and the app shows a small amount of advertising.
- Starter — a monthly subscription. AI analysis of entries, MoodAI chat, reading aloud in the default voice, mood trends for up to 30 days.
- Pro — a monthly subscription. Everything in Starter plus all reading voices available for your language, text recognition from photos on our servers, trends for up to 90 days and higher AI limits.
THERE IS NO TRIAL PERIOD. A paid plan begins immediately after payment.
In the app, subscriptions are purchased only through the App Store (Apple) or Google Play (Google). The store shows the price of a plan before purchase, in your currency and including the taxes of your region; it may differ between countries and stores. Payment is charged to your Apple ID or Google account when you confirm the purchase.
A subscription is purchased for 1 month and renews automatically for the same period until you cancel it. The store charges for a renewal at the end of the current period (the App Store does so within the 24 hours before it ends), so to avoid the next charge, cancel at least 24 hours before the period ends. If the price changes, the store will tell you in advance under its rules and, where required, ask for your consent.
A subscription bought in the app is cancelled and changed in the subscription settings of your Apple ID (Settings → Apple ID → Subscriptions) or Google Play (Google Play → Payments & subscriptions → Subscriptions). You can also move from Starter to Pro in the app — the store applies the change and adjusts the charge under its own rules. The app cannot cancel a store subscription for you, and deleting the app or your account does not cancel it. After cancellation, access to paid features remains until the end of the period already paid for, and no further charge is made. Refunds are described in section 8.
If you subscribed on our website, payment is processed by Stripe and the subscription is cancelled in the Stripe billing portal. In none of these cases do we receive or store your card number.
8Right of Withdrawal and Refunds
If you are a consumer in the European Union, the EEA or the United Kingdom, you have 14 days from the date of purchase to withdraw from it without giving any reason.
Andesha supplies digital content and digital services immediately after payment. When you start using paid features you expressly ask us to begin performance during the withdrawal period and acknowledge that, once the service has been fully performed, you lose the right of withdrawal for the part already supplied. If you withdraw earlier, we refund the amount in proportion to the part of the service you have not used, taking into account any AI tokens already spent.
To withdraw, write to amirich.corp@gmail.com from the email address linked to your account and state the purchase. We do not require a particular form.
How the money is returned depends on where you paid:
- App Store — only Apple can refund App Store purchases. Request a refund at reportaproblem.apple.com; Apple decides under its own rules. Where these Terms say that we refund an amount, for App Store purchases we will help you file that request with Apple.
- Google Play — request a refund through Google Play under the rules of Google, or write to us: we can refund a Google Play purchase ourselves.
- Our website — refunds are made through Stripe to the same payment method within 14 days of our decision.
If you are outside these jurisdictions, refunds follow the mandatory rules of your own country and the rules of the payment provider or app store through which the purchase was made. Where the law does not require a refund, subscription payments are non-refundable.
If you believe a charge was made in error, contact amirich.corp@gmail.com before opening a dispute with your bank — this is usually much faster.
9AI Token Packs
In addition to subscriptions we sell one-off packs of AI tokens.
- In the app, packs are bought only through the App Store or Google Play as one-off purchases; they do not renew automatically. The store shows the price of a pack before payment, in your currency.
- Pack tokens are spent before the tokens included in your plan and are not limited by the daily, weekly or monthly limits of the plan.
- Packs work only while a Starter or Pro subscription is active. If the subscription ends, the remaining tokens are kept and become available again when you renew.
- Tokens do not expire while your account exists, but they cannot be transferred to another account or exchanged for money.
- Unused tokens are not refunded — including after you cancel a subscription, switch plan or delete your account — except where a refund is required by law or by the section on the right of withdrawal. Refunds for store purchases are made as described in section 8.
Your current token balance and its consumption are always visible in the app. Pack prices may change for future purchases; a pack you have already bought is not affected.
10Advertising on the Free Plan
Advertising is shown only on the Free plan, and it is what makes that plan possible with no time limit.
Ads are delivered through Google AdMob in non-personalised form. We do not pass your diary entries, transcripts, analysis results, photos, voice recordings or email address to advertising networks, and we do not build advertising profiles from your mood data.
What data Google receives, how consent to advertising is requested in the European Economic Area, the United Kingdom and Switzerland, and how to change it is explained in section 11 of the Privacy Policy.
There is no advertising at all on the Starter and Pro plans.
11Your Content
Everything you create in Andesha stays yours: entries, voice recordings, photos, transcripts, conversations with MoodAI and goals.
So that the service can work, you grant us a limited, non-exclusive and revocable licence to store your content, transmit it to the AI providers listed in the Privacy Policy, process it in order to produce analysis, summaries and answers, and display it back to you. This licence exists only to operate the service and ends when you delete the content or the account.
We do not sell your content, do not publish it and do not use it to train AI models. Andesha staff cannot read your entries: the content is stored encrypted, and the admin panel shows only account and payment data.
Statistics we use to improve the product are aggregated and impersonal — for example the number of requests or errors, not the text of your entries.
You are responsible for what you put in the diary. Do not upload other people's personal data or content that you have no right to use.
12AI Processing and Providers
The AI features of Andesha run on OpenAI. When you use them, the following is transmitted:
- the text of entries — for analysis, chat and daily summaries;
- audio files of voice entries — for transcription and analysis;
- images — when text is recognised from a photo;
- the text you ask to be read aloud;
- in live voice mode, audio goes from your device straight to OpenAI servers over a real-time connection.
A pseudonymous identifier (a hash) is sent with the requests instead of your email address.
Reading aloud in Russian, Ukrainian and Tajik is performed by our own speech synthesis on our servers: this text is not sent to OpenAI and does not consume AI tokens. For other languages, and if our synthesis is unavailable, the text is voiced by OpenAI or by the built-in voice of your device.
The details, the legal bases and international transfers are set out in the Privacy Policy. If you do not agree to this processing, do not use the AI features — the diary works without them.
13Limits of AI Analysis
AI analysis is based on machine-learning models and can be wrong. Mood, stress and energy scores, summaries, trends and MoodAI replies are algorithmic interpretations: treat them as an approximate reference point, not a verdict about you.
Voice analysis takes into account tone, tempo, pauses and other speech characteristics; the result is an estimate and is unsuitable for clinical or diagnostic purposes. Text recognised from photos may contain errors.
AI can produce inaccurate or inappropriate statements. If you receive an answer that seems harmful or wrong to you, stop the conversation and tell us at amirich.corp@gmail.com.
You can always ignore an AI assessment, delete it together with the entry, or ask for a human review at amirich.corp@gmail.com. Your rights regarding automated processing are described in the Privacy Policy.
14Prohibited Conduct
When using Andesha you agree not to:
- use the service for unlawful purposes or to harm other people;
- try to gain access to other users' data or to parts of the service not intended for you;
- reverse-engineer, decompile or extract the source code;
- use bots, scrapers or other automated tools, or create a load that disrupts the service;
- abuse the AI, including attempts to bypass restrictions or generate prohibited content;
- pass your credentials to others or resell access;
- circumvent plan limits, token accounting or advertising on the Free plan;
- upload malicious files or other people's personal data without a lawful basis.
If these rules are broken we may restrict features, suspend or terminate the account. Where possible we warn you first; in the case of a serious violation, immediately.
15Intellectual Property
Andesha — the app, its design, code, interface, name and logo — belongs to Amirich LLC and its licensors. These Terms give you a personal, non-transferable right to use the app and grant no other rights.
You may not copy, modify, distribute or create derivative works from parts of the service without our written permission. Third-party components are used under their own licences.
Text produced by the AI in response to your entries is provided to you for personal use. We make no claim to your entries themselves.
16Termination, Deletion and Discontinuation
You can stop using Andesha at any time and delete your account in the app settings. Deletion works like this:
- the account is deactivated and moved to an archive for 50 days;
- during this period you can restore everything simply by signing in;
- after 50 days a background process on our servers permanently deletes entries, transcripts, analysis results, conversations, audio files, photos, the avatar and all related data. Restoration then becomes impossible.
Deleting the account does not cancel a subscription bought through the App Store or Google Play. Cancel it in the subscription settings of your Apple ID or Google Play account, otherwise the store will keep charging you.
After deletion we keep only purchase and payment records without a link to the account, impersonal advertising statistics and, for a limited period, security and technical logs of the service without diary content; details are in sections 14 and 15 of the Privacy Policy.
We may suspend or terminate an account for a serious breach of these Terms, and may also block access if it is necessary for security or required by law. If we terminate the account and the breach was not deliberate, we refund the unused part of a paid period.
If we decide to close Andesha, we will let you know by email and in the app at least 30 days in advance, stop charging subscriptions, refund the unused part of a paid period and keep data export available until the announced shutdown date.
Export your entries before deletion: after the archive period they cannot be recovered.
17Limitation of Liability
Andesha is provided "as is" and "as available". We do not promise that the service will work without interruption or errors, or that AI analysis will match your own perception of your state.
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, lost profit, or decisions you take on the basis of AI analysis. Our total liability on any claim is limited to the amount you paid us during the 12 months preceding the event that gave rise to it.
These limitations do not apply to liability that cannot be excluded by law — including liability for intent, gross negligence, harm to life and health, and the mandatory rights of consumers.
Keep your own copies of important entries. The app lets you export your data — do this before deleting your account.
18Governing Law and Disputes
These Terms are governed by the laws of the State of New York, United States, and applicable federal law, without regard to conflict-of-law rules.
This choice does not deprive you of the protection afforded by the mandatory consumer rules of the country where you habitually reside. If your national law gives you more rights, those rules prevail.
Please write to amirich.corp@gmail.com first: we try to settle disputes informally within 30 days, which is usually faster than any formal procedure. If that does not help, a consumer may bring a claim in the courts of their place of residence. Consumers in the EU may also use the European Commission's online dispute resolution platform and national alternative dispute resolution bodies.
Claims are brought individually. We do not use class actions or mandatory arbitration.
19Changes to These Terms
We may change these Terms — for example when features, prices or legal requirements change. The current version and its date are always shown at the beginning of this document.
We will notify you of material changes by email or in the app at least 14 days before they take effect. If a change concerns processing that requires your consent, we will ask for that consent again.
If you do not agree with the new version, stop using the service and delete your account before the change takes effect; on a paid plan you can cancel the subscription and get back the unused part of the period as described in section 8. Continuing to use the app after the effective date means you accept the new version.
Changes never apply retroactively to disputes that arose before them.
